Data breach and payroll update

Dear SEIU 1021 City of Oakland member:

The situation with the City’s ransomware attack, data breach, and payroll issues is still ongoing and evolving. We are continuing to meet regularly with them to resolve this and protect our members. Here is what we know for now:

  1. If you were underpaid, expect to be made whole Monday, March 6 — be sure to check your pay stub online, and contact your payroll clerk or union representative if there is any issue
  2. If you were overpaid, you do NOT need to sign anything the City gives you: please see the contract language below, and request the City deduct the overpayment at 5% of the gross salary per pay period until the overpayment is recouped by the City

In the event the City erroneously overpays a unit member regardless of fault, the City shall recover overpayment as described in Section 5.3.1.1

5.3.1.1 The City will provide written notice to each employee when he/she receives a wage overpayment. The notice will advise the employee of the amount of the overpayment and request that the employee either reimburse the City for the full amount of the overpayment or consent to deduct the overpayment from the employee’s paychecks, five percent (5.0%) of the employee’s gross salary per pay period, for as many consecutive pay periods as is necessary until the overpayment is recouped in its entirety. The notice shall also advise employees of the right not to consent, provided however, the City may pursue appropriate legal action.

If you have any questions, please contact your union rep or SPOC. You can also call the SEIU 1021 Member Resource Center (MRC) to speak one-on-one with a member of the SEIU 1021 staff. The MRC is available to Local 1021 members from Monday through Friday from 8 a.m. to 6 p.m. at 1-877-687-1021.

The City has issued a comprehensive timeline available at the link below, but you should be aware that the situation is still changing, and some of the dates have already not been met.

The City has notified some employees that their personal data may have been involved in this security incident. It is not clear at this time whether the personal data of all Oakland employees and SEIU 1021 members was involved. Check your City email account for updates and if you have questions, email the following address and copy your union representative or steward:
